Terms & Conditions

  1. Equipment is only hired to members of the public over 18 years old. Anyone under 16 and those who cannot swim must wear a life jacket at all times.
  2. The Company reserves the right not to hire equipment to any person it considers unsuitable to operate the vessel.
  3. No liability is accepted by the Company for loss of or damage to the Hirer's belongings.
  4. No liability is accepted by the Company for injury to or death of the Hirer during the hire or during embarkation or disembarkation.
  5. If the contract is cancelled by the Company due to bad weather, the Hirer will be given their money back.
  6. Full tuition in handling the equipment will be given to the Hirer. It is the Hirer's responsibility to confirm that adequate instruction has taken place. Safe navigation of the equipment and all passengers then becomes the responsibility of the Hirer.
  7. The Hirer will use the equipment consistently with the rules of navigation and consider other users of the Mar Menor at all times. The equipment must never be taken into no-go areas specified in the briefing.
  8. The Hirer is responsible for late return fees (€20 per half hour) if equipment is returned late for any reason.
  9. The Hirer will ensure all members of the party comply with these terms and the safety briefing.
  10. The Hirer is liable for all damage to the equipment and its contents caused by their use of the vessel.
  11. The Hirer is liable to pay for any breach of our rules, including excessive noise or standing on the seats.
  12. The Hirer will return the equipment in the same state and condition as when hired.
  13. Equipment can be hazardous. While the Company takes all reasonable care in preparing the vessel and providing safety equipment, the Hirer is responsible for their own safety, that of third parties, and the safe return of the vessel, and is liable for any loss or damage caused by their action or negligence.
  14. In particular the Hirer must ensure: passengers do not stand on the sides or seats; passengers remain inside with weight balanced evenly; suitable buoyancy aids are worn where appropriate; anyone in control remains sober (alcohol limits as per Public Road Traffic Acts) and conforms to general water restrictions.
  15. We reserve the right to decline a booking or refuse to hand over equipment to any person who, in our opinion, is not suitable to take charge.
  16. We reserve the right to repossess the equipment at any time — e.g. after an accident or damage, where we believe an accident may occur due to the Hirer's unsuitability, where more passengers are aboard than listed, or where the Hirer causes a nuisance. In such cases no refund of hire charges or deposit will be made.
  17. We are not liable for death, personal injury, or loss or damage to your property or that of passengers unless caused by our negligence.
  18. The Hirer is in charge of the equipment and responsible for safe navigation. In any accident, it is the Hirer's responsibility to record the names and addresses of those involved and any witnesses, and never to admit liability. All accidents and damage, however minor, must be reported on return.
  19. The equipment is fully insured, but the Hirer is responsible for the cost of any loss or damage to the vessel. Cover excludes personal belongings, damage from careless or reckless behaviour, and any malicious, deliberate or alcohol-affected act. The Hirer is responsible for any costs arising from such incidents.
